Full terms and conditions for The Really Wild Emporium (Parent Company: Pembrokeshire Seaweeds Ltd) applicable to all products and services within the; Restaurant, Shop, Courses and Accommodation.
Please read these terms and conditions carefully before making a booking, or buying a voucher. Once a completed booking has been accepted all the persons named on the booking form (“the clients”) will have entered a binding contract on the basis of these terms and conditions. 1.AGREEMENT
1.1 Agreement on the basis these terms and conditions arise upon once a booking has been made.
1.2 ’The Really Wild Emporium’ reserves the right, in its absolute discretion and without the need to give reasons, to refuse to accept a booking. In such circumstances, no agreement arises and The Really Wild Emporium will return any payment accompanying the booking.
1.3 The agreement is between The Really Wild Emporium and the client(s) and is the sole agreement between those parties. No variation of these terms and conditions shall be applicable unless agreed in writing by The Really Wild Emporium before the relevant booking. The person booking shall be deemed to sign that form for his / herself and as agent for all other persons listed on that form and warrants that he/she is appointed agent for that purpose.
2. PAYMENT
The balance of the fee as specified on the booking must be paid in full by the date specified on the booking, If not so paid, The Really Wild Emporium reserves the right to treat the agreement as cancelled by the client(s) as per the cancellation policy.
3. PRICES
Whilst every effort is made to limit prices to those given in the booking, The Really Wild Emporium reserves the right to alter prices should its costs increase for reasons beyond its reasonable control (including, without limitation, the cost of labour, transport and materials). In the event that a price is altered, the client(s) will be notified as soon as reasonably possible and the balance of the altered price will be payable on the same terms as was the original price.
4. VOUCHERS
4.1 Really Wild vouchers are redeemable throughout the Really Wild Emporium, this includes the Restaurant, Shop, Courses and Accommodation.
4.2 Really Wild Vouchers are valid for 12 months and are non-refundable.
4.3 By purchasing a Really Wild Voucher, you also agree to our terms and conditions and cancellation policies listed.
5. VARIATION OF A COURSE BY THE REALLY WILD EMPORIUM
The Really Wild Emporium foraging courses are, by their very nature, exposed to natural variables, including the weather. Whilst every reasonable effort is made to
deal with such contingencies there may be occasions when The Really Wild Emporium, through no fault of its own, is forced to vary or modify a course itinerary at short notice or decides to do so in order to take advantage of natural circumstances. The client acknowledges that information about courses provided by The Really Wild Emporium is given in the best of faith but that because of the variability of nature it may be reasonable to alter or modify a course. In such circumstances it is not reasonable for The Really Wild Emporium to be liable for any losses consequential on such a change and that The Really Wild Emporium liability is limited accordingly.
6. THE CONDUCT OF CLIENTS ON A COURSE
The client acknowledges that during a Really Wild Emporium course he/she is required to submit to the reasonable instructions and leadership of the course leader. The client acknowledges that persons attending a Really Wild Emporium course are entitled to expect a high standard of conduct and regard for personal well-being on the part of all clients. For this reason, the client accepts that the course leader may, in its absolute discretion and without the need to give reasons, arrange for him/her to be removed from the course. Circumstances in which this might occur include (without limitation) disorderly or abusive conduct; intoxication; inadequacy of clothing or equipment; incapacity or inability to meet the rigours of the course. In such circumstances, the client will not be entitled to a refund of monies and The Really Wild Emporium will not be liable for any losses resulting. The client will on demand reimburse The Really Wild Emporium for its reasonable costs of effecting his/her removal.
7. LIABILITY
7.1 The Really Wild Emporium courses take place in the open countryside and are by their very nature not absolutely free from hazards. The Really Wild Emporium makes every effort to minimise risk to clients and instructs clients in the safe negotiation of such risk as may remain. Consequently, the client acknowledges that there are circumstances in which an accident could befall a client without The Really Wild Emporium being at fault and accepts that to that extent he/she is taking part in a Really Wild Emporium course at his/her own risk. The Really Wild Emporium only accepts liability for physical injury to a client that is shown to result from obvious and complete negligence on the part of The Really Wild Emporium. The client acknowledges that other loss, damage and expense (including, without limitation, loss of money, loss or damage to clothes and possessions, losses arising on the cancellation of a booking and the expenses of delay and harm caused, other than by the negligence) The Really Wild Emporium is not the responsibility of The Really Wild Emporium and that The Really Wild Emporium liability is hereby limited.
7.2 During a course or event The Really Wild Emporium acts as wild food advisors. It is within the clients own choice as to whether or not they wish to eat the samples provided to them. The client, therefore, takes liability for their own wellbeing. All foods discussed are either previously recorded as edible or have been eaten by the course leader, clients are in no way obliged to eat anything.
7.3 Consumption of wild foods on Really Wild Emporium Courses and in the Really Wild Emporium Restaurant can potentially cause allergic reaction in certain individuals; we advise trying only small amounts of new wild foods on first consumption and there’s always the possibility of freak reaction which has no grounding or basis on the individuals common bodily reactions to food The Really Wild Emporium and its associated practitioners take no liability on such occasions.
7.4 The Really Wild Emporium is not liable for guests consumption of any wild foods after an event has finished, this includes wild foods that are collected during an event and taken away by guests to consume separately to the event.
8. ALLERGENS AND DIETARY PREFERENCES
Any dietary requirements MUST be provided no later than 24 hours before your booking in order to ensure that a suitable menu is available in The Really Wild Emporium Restaurant. Any dietaries announced after this time cannot be guaranteed to be catered for. Whilst we are very careful when preparing meals for people with allergies, we cannot totally guarantee that there is no cross- contamination as we do have other allergens present in the food preparation area.
9. INSURANCE FOR OUR FORAGING COURSES
The Really Wild Emporium is insured as an Outdoor Activities provider and is covered to a level of £5,000,000 Public Liability Insurance. All clients are also strongly advised to provide their own personal insurance cover, to include ‘working with hand tools and eating wild foods’.
10. COMPLAINTS
10.1 Courses: In the unlikely event that a client has cause for complaint about a The Really Wild Emporium course. The complaint should be made to a representative of The Really Wild Emporium during the event, in order that corrective action can, if necessary, be taken. The client acknowledges that it is unreasonable to take no action during a course but to complain later. However, should a problem not be resolved, a complaint should be made in writing within 28 days. To the extent permitted by law, The Really Wild Emporium will not be liable in respect of claims first intimated later than 28 days from the end of the relevant course.
10.2 Restaurant / Shop: Should you have a complaint relating to our Restaurant or Shop, whether this is an experience that you had whilst shopping or eating with us or an item that was purchased from the Really Wild Emporium shop then a complaint should be made initially to staff. If not resolved then in writing within 28 days.
10.3 Accommodation: If you’re experiencing an issue during your stay, you can ask us to resolve it, request a partial refund, or request to cancel your reservation for a full refund. It’s important to submit your request within 24 hours of noticing the issue, and we will have 1 hour to respond. The outcome will be at our discretion based on the severity of the issue.
10.4 Should a problem not be resolved immediately, a complaint should be made in writing and emailed to info@reallywildemporium.co.uk. We will respond within 7 days with our best attempts to resolve an issue.
11. SUBSEQUENT INSTRUCTION BY THE CLIENT(S)
Although all The Really Wild Emporium courses are taught by highly experienced and capable leaders, it is not intended that any instruction provided to any client(s) while on a course will in any way qualify those clients to instruct any third party and no warranty is made to that effect. The Really Wild Emporium hereby excludes any liability it might have to any third party in respect of any loss or damage suffered or incurred by that third party in its reliance on any skills taught by any client(s) on the basis of having attended any The Really Wild Emporium course.
12. INSOLVENCY
In the unlikely event that The Really Wild Emporium becomes insolvent, where possible all monies will be refunded in full.
